What Texas Personal Injury Law Says About Crash Bystanders and Mental Anguish

According to Dallas car wreck lawyer Amy Witherite, who is has no connection with the victims of the aforementioned crash, a surprising number of individuals go through the hardship of witnessing their loved ones’ involvement in a serious traffic accident. Says Witherite “there was one case in particular handled by our law firm that will always stand out to me because of the challenges faced by multiple members of the same family who witnessed their loved ones sustaining catastrophic injuries after being hit in a chain reaction crash involving an 18-wheeler. Due to the emotional toll it took on them, we pursued a bystander claim for mental anguish, which is something many in this type of predicament are not aware even exists.”

In accordance with Texas personal injury law, bystanders who are closely related to a person severely injured or killed in a traffic crash can pursue legal damages against those responsible for their related emotional distress. Witherite suggests that in cases like the aforementioned crash, it is important for families of victims to get a proper assessment of their legal options, which could prove to be an essential element of helping them move forward in the aftermath.

A GoFundMe account has been set up for the family of the victims.
